WHAT IS COLLABORATIVE NEGOTIATION?
"Collaborative Negotiation" is a form of alternative dispute resolution for divorcing couples who would like to avoid litigation. Collaborative divorce is a process in which both parties and their attorneys agree in advance to commit themselves to completing their divorce without resorting to court. Instead, the parties and their attorneys participate in a series of conferences. The process emphasizes mutual respect, fundamental fairness, creativity, and voluntary cooperation, all with an eye toward minimizing the negative aspects of divorce.

Those attorneys who practice collaborative law have received specialized training and are often family law specialists. One of the key features of the collaborative divorce is a written agreement, known as a "Stipulation and Order re: Collaborative Law," signed by both parties, their attorneys and a judge, which sets forth the guidelines for the process.
